The American Recovery and Reinvestment Act of 2009, in Section 13411 of the HITECH Act, require HHS to conduct periodic audits to ensure covered entities and business associates are complying with the HIPAA Privacy and Security Rules and Breach Notification standards. The HITECH Act significantly increases the penalties and strengthens HIPAA enforcement actions, making business associates directly subject to penalties. The HITECH Act mandated that Office for Civil Rights of US Department of Health and Human Services (HHS) conduct audits in the healthcare organizations to ensure the HIPAA compliance.
