In general, there are no patient / insured rights waiver provisions in HIPAA. In particular, 45 CFR 164.508 (b) (4) 'Prohibition on conditioning of authorizations' applies ... for starters.

wow, agree - I also thought I misread. I hope they are in the process of updating their policies.... and their BAA's if that type of thinking found its way into those agreement too.

Gets better, all. This is actually a quote from a template employment manual developed by an outsourced human resources consulting firm. So - there are more than just this poor misled BA with this statement floating around.

Not just a template employment manual. The phrase "normal for providers and health insurance plans to require the waiver of HIPAA rights as a condition of service" also turns up in some healthcare provider training documents. Paste the words in a search box and give it a whirl.
