DUII Obtained US Patent Focusing on DNA Sample Tracking
Data Unlimited International, Inc., – United States Patent and Trademark Office (USPTO) awarded US Patent Number 6,748,399 ‘Performance-based Expert Witnessing’ to Data Unlimited International, Inc. (DUII) on June 8, 2004 for DUII’s DNA sample tracking process. The ultimate goal of the innovation is to enable DNA scientists to testify in the court as expert witnesses using structured DNA evidence information. The USPTO examiners indicated that DUII intellectual property claims exceed the prior art and thus are novel and patentable. DUII claims include preparing to take the testimony of a witness including the steps of storing case evidence in a database, associating the evidence in the computer database with a deposition question or witness answer, and viewing this association. In another embodiment, associating the evidence includes associating the evidence in real time. In a further embodiment, case evidence includes testimony, pleadings, or documents, and the database includes either a local or remote database. Courtroom admissibility of DNA scientific evidence requires courts to scrutinize their quality and suitability. Expert witnesses must collect, understand science, and apply to the facts of the case. To uniformly and comprehensively present DNA scientific evidence generated by paper-based casework has been time-consuming, error-prone, and labor-intensive due to the vast paper volume. The inventive method employs computer network to gather DNA scientific evidence and retain them using an Electronic Case Folder (ECF) and database categorizing DNA scientific evidence in defined sequence with page number and time stamp. The invention relates generally to courtroom admissibility, but specifically to presenting DNA scientific evidence and to enabling the justice system to determine the facts and legal issues using the documentation, evaluation, and learning tools of the ECF.
